Big tension between neo-liberalism and social welfare state has been getting higher since 1980s. In this social context, one of the most important themes in social sciences is to develop the logic of social rights. J. Habermas developed his theory of social rights in "Theorie des Kommnikativen Handeln" from the perspective of 'inner colonization of lifeworld by System'. He wanted to explain not only the crisis of welfare state but also 'reflexive continuation of the welfare state project'. But in my opinion he could not completely make it clear how to develop social rights. This drawback is related with his notion about the two categories 'law as medium' and 'law as institution' which stemm from his basic idea of system and lifeworld. Also this is connected with his characterization of lifeworld. I want to point out that the notion of lifeworld should be reconstructed more concretely from the perspective of social classes again. Because in order to develop social rights, we have to think the original form of lifeworld established by the workers movement as well as it's contemporary forms strengthened by the people who suffer the presure of neo-lib-eralism. G. Esping-Andersen also developed his theory of social rights from the perspective of 'decommodification'. He strongly emphasized the political character of Scandinavian type of welfere state. Although Esping-Andersen emphasizes the developmental process of social rights by workers movement and political alliance, he has no vision about the reification by social rights that Habermas defined. I pursue to synthesize two positions toward the theory of welfare state in global capitalism.
