再論社会変動中の個人と国家 : 中国・強制的婚前検査の廃止が示すもの

In China, before you register a marrige, you were obliged to have a physical examination and present the certificate to the town office. If you were found to have the diseases or physiological defects which are considered not to be suitable to marry, you were going to be told to give up the marriage or postpone it until the disease is cured. This system was abolishied recently. This not only shows that the freedom of marrige is being expanded, but also shows that the relation between the state and individuals is experiencing a bigger change. In another paper presented in this journal, I took up the changing attitude of Chinese people towards compulsory physical examinations. This paper will reivew the change and raise some new problems accompanied by the abolition of the old system. The most serious problems that are apprehensive about are the decrease of couples who voluntarily accept the physical examination and the increase of births of the handicapped because of the heriditary diseases which can be prevented in the physical examination. In a certain sense, it is a dilemma. The paper will not be able to present a specific solution, but will show how people in other societies have been dealing with these problems,in order to promote awareness of the difficlt choice between freedom, rigths and the price we have to pay for them.
