It has been almost 120 years since the Imperial Rescript on Education was promulgated in 1890. This had held an integral role in our society not only as the fundamental philosophy of education but also as the conventional wisdom for 57 years until the promulgation of the Fundamental Low of Education. From the very beginning, the Imperial Rescript on Education aimed to define the basis of our morality. At present, the fundamental framework of our education is set by the Fundamental Law of Education and it is quite easy to say that the Imperial Rescript on Education is no longer effective. However, if education or laws are considered to mature over time, influenced by historical background or constraints. It may be appropriate to state that the Imperial Rescript on Education had a great effect on the Fundamental Law of Education, and that the latter was established as a revised version of the Imperial Rescript on Education in the wake of criticisms of it. Now in Japan, there has been a move to amend the Fundamental Low of Education to be suited to the new era. The proposed revision includes phrases like 'Japanese identity' or 'public-mindedness', which remind us of the values praised in the now obsolete Imperial Rescript. This Paper aims to figure out the spirit of 'Jingi-tyuukou', obligation and loyalty in the society, exhorted in the Imperial Rescript on Education and examine the transition of its meaning through time (in chronological order). We believe this will be the key to discern what would be necessary and what would not for the new the Fundamental Law of Education.
