Will the amendment of the Fundamental Law of Education be materialized? Although it is still uncertain whether the amendment bill will pass the Diet in session, it seems that debates on the amendment have reached the most crucial moment. Opposing arguments have been actively expressed both inside and outside of the Diet as well. The present paper explains how the Fundamental Law of Education was established and reevaluates its legal characteristics in conjunction with historical and cultural features the Japanese society contains, and furthermore tries to prove that the amendment is justifiable.
