This paper will introduce the effect of Tentative Probationary Supervision on juvenile delinquency in Japan as an alternative procedure for preventing a juvenile delinquent from a repeat offense. The Japanese Tentative Probationary Supervision has a unique characteristic in the procedure of hearings for juveniles which is somewhat similar to probation in the West. This paper will chiefly discuss the efficiency of Tentative Probationary Supervision and hypothesize that Tentative Probationary Supervision method can produce better result than stricter measures (the current procedure), particularly among younger juveniles and nonhabitual delinquents. In the late 1970's, juvenile delinquency was one of the major concerns in Japanese society. As the number of cases increased, juvenile law in Japan has developed and diversified. The Japanese police have also developed a new policy "Find and Correct in the early stage" under the existing law. As a result, the number of juveniles who are sent to family courts has increased. However, the increase in the number of clearance and guidance due to increased police activity against juveniles does not mean an increase in the number of juveniles who receive protective measures right away. Also, the Japanese family court should not apply the same measures to all delinquents. The question arises : What is the most appropriate procedure? I think we should pay attention to the effect of Tentative Probationary Supervision again and use it more frequently. Many cases which employed Tentative Probationary Supervision showed promising results. Past examples suggest that Tentative Probationary Supervision may be a more effective procedure than harsher measures. 1. Introduction 2.
