The key element of the transaction system of the right to carbon emission is the allocation of such right. The initial quota of the right to carbon emission concerns the reallocation of the whole social wealth and will exert adverse infl uence on the potential competitors entering the market. Therefore, environment protection department should act according to certain principles and means of the allocation with deal caution. Such principles and means are diversifi ed, but in order to avoid and reduce bad results to the economic system, China environment protection department should take all measures to comply with the principle of fairness through such means as free allocation, auction, bidding, repurchasing, recycling, when fi rst allocating initial quota of the right to carbon emission to provinces, autonomous regions, and municipalities directly under the Central Government. Then local government responsible department will reallocate such right to the enterprises that make pollution. With the progress of technology, such enterprises and some regions may make use of surplus and spare index among the initial quota for trading by auction and many ways.
