The aim of this paper is to clarify the relation of law and norm about education and school hygiene in Meiji period. Law has the character of transcendence, abstractness and absoluteness. On the other, norm has the character of concreteness, positiveness and relativeness. In modern law, these two characters are both existed.// In Japanese education history, this occurrence was happened in Meiji period, about the concern of school hygiene especially. Dr. Mishima Tsuuryo researched schools, school places, children by the aspect of hygiene in Meiji period, and he made the statistic norms of those for law. His research and approach to government changed the law of school hygiene, and the character of the law had also changed.// In Japan, there were law systems of order by emperor, and schools were regulated by that. By the texts of law, the authority of school systems and school government were derived from that order mainly. But norms which had been made by Mishima influenced the law, so, actually, the law of school hygiene was authorized by norms and medical sciences.
