This article examines why in Japan the administrative branch handle matters related to the safeguard, by analyzing the history of Japanese trade policy process. The safeguard provision allows each nation to impose measures such as levying tariffs in order to help temporarily domestic industries seriously injured by rapid increases in imports. Currently, in Japan, several national ministries have authority to investigate injured industries and handle matters pertaining to the safeguard. By contrast, in the U.S., the International Trade Commission (ITC), a single agency independent from the legislative and executive branches, takes on the responsibility of the investigation. This article concludes that the Japanese present from of institutions handling the safeguard is a legacy of the period from the 1860s to the 1930.
