This report explains the substance of modern administration for the preservation of mounded tomb, as an example of, transition of legend ground supposed to be the tomb of emperor Chuai mausoleum in Uehara (Kawachinagano-City, Osaka Prefecture). In the early Edo period, the Shinto Shrine that was component of the Emperor mausoleum,. However it had gradually been changed to be only object for religion separately with when it was denied the legend of tombs of emperor or the imperial family as to be recognized a mere mounded tomb. After Meiji Restoration, the legend grounds of the tombs of the emperor or the imperial family was recognized as the component of the Shinto shrine. However, thereafter, forests and lands surrounding mounded tombs had been disposed to shrine and others to reclaim. It has been prompted by the national policy of reorganizing shrines and temples. Then, the judgment and the permission concerning the mounded tombs preservation by the administration were needed. In the result, when the Imperial Household Ministry acknowledged non-tombs of the emperor or the imperial family, the disposing of these lands has become possible. The preservation of the mounded tombs changed greatly whether it related to the tombs of emperor or the imperial family until a new preservation measure by the enactment of "The act of preservation of historic site place of scenic beauty and natural commemoratives" in 1919. In a word, the mounded tomb that had been recognized as non-tomb of emperor or the imperial family did not take the preservation measures in the administration. In conclusion, in the Edo era, the people in the region had believed and sacred as the tomb of emperor or imperial family. However, after the Meiji era, the national "Shinto" system and the modern "Tenno" system by the government reorganized shrines and temples. As the result, the preservation of the legend ground for Emperor Chuai mausoleum has been discarded.
