An aim of this paper is to argue a reflective consideration for the democracy in Japan after World War II from the view point of the Constitution, Fundamental Law of Education, and problems of Yasukuni Shrine. We are now in progress of big paradigm-shift for the globalization of social cooperation. However, we are facing some dangers of short-sighted nationalistic policy, especially, of diplomatic policy. In such a doubtful and critical condition, we must go back to the basics or original position, i. e. Potsudam Declaration, and remember our original intention swore by all the human beings in the world. The conclusion is as follows : 1. The democracy in Japan is not matured yet. 2. The amendment to the Constitution is not allowed. 3. The amendment to the Fundamental Law of Education is not allowed. 4. In view of the Constitution, the pay homage at Yusukuni by officeholders, and/or public officials are not allowed. 5. A non-religious memorial facility for enshring all the people who died in the World War II must take the place of Yasukuni Shrine.
