In Japan, the people have seen great scandal in politics and economics. Especially, the Recruit scandal has undermined the democracy Japan built after its defeat in the World War II . Many Japanese worry that diet-members will block the political reform. A mind growing public distrust in the government, probability of the political reform will depend on the establishment of the political ethics.In the U. S., on the other hand, after a direct influence of the Watergate and Congressmen's scandal, the President Carter promised to restore public trust in the integrity of the government. In October 1978, the Congress and president Carter passed the Ethics in Government Act. This act included provisions for the public financial disclosure of the top officials, the appointment of special prosecutors, tighter restrictions on the lobbying by former officials, and the establishment of the office of Government Ethics. The act was signed to assure effective action against high-level officials and congressmen who violated the law. When congress enacted the Ethics in Government Act of 1978, supporters thought that financial disclosure would solve the problems of public integrity and the conflict of interest. But after ten years, the experience of the Reagan-Bush administration has demonstrated the serious misconduct of the high-level officials and congressmen. The purpose of this paper is to examine of the enactment and application of the Ethics in Government Act of 1978.
