The Japanese people currently desire a thorough and detailed reform of the social security system. First, Japan is now undergoing a transition period from an aging society to an aged society. That is to say, the problem concerning elderly persons in Japan is characterized by the rapid growth of not only the average life span and but also the percentage of elderly persons in the whole population. This aging Japanese population has many difficult problems to solve: the pension scheme, health insurance and nursing care. They need an immediate solution. Second, the cumulative deficit of deficit government bonds makes the finances of the state tight. As a result, we may impose a tax burden on the younger generation. We have to find a way out of the present financial crisis and find an equitable solution to the contributions and provisions of the pensions among generations. Third, the new social security system has to meet the demands of the present Japanese people originating in change of both the standard of living and the conditions of the society. To my regret, we cannot answer these questions using the old social security system, therefore, we have to demand a reform of the social security system. In this paper, to begin with, I attempt to state the unstable life circumstances of elderly persons that occur in the present poor system. Second, I attempt to investigate the foundation of the legal system in the aged society, especially the idea of law which guarantees the life security of elderly people. Third, I attempt to reseaech the social solidarity by the methodology of cultural anthropology and examine the new social security system. Finally, I will attempt to design a new social security system and social welfare system for the 21st century.
