In October 2002, a tentative draft "Treaty Establishing a Constitution for Europe" was presented to the European Convention. This Convention was oranized in December 2001 bringing together representatives from governments and parliaments of EU Memberstates, the European Parliament and the European Commission. The purpose of this Convention is to formulate a clearer, improved framework for the future development of the European Union. The process of the European integration began about half a century ago. Now that it has developed to the European Union, the common market has been established and the euro the common currency is now in place. The number of member countries will become about 30 in the near future. And so there must be new challenges to be met. To answer these requests, the above-mentioned Convention was organized. The discussion is continuing now, and the conclusion will be reached in July of this year. The purpose of this paper is to intend to introduce and explain the draft text of the Constitutional Treaty with some comments, the focus being set especially on the legal personality, the competence of the Union and the role of national parliament.
