This paper aims to contrasutothe usage of modals and noice used in the English and the Japanese versions of the Japanise Constitution. In the first part, we focus on how differently the modals "shall" and "will" are used mainly in human rights articles and Article9. In the second part, we discuss why there is noice cinversion between the Engilish and the Japanese versions. That is, the passive voice in the English version changes into the active in the Japanese. Four possible reations, from legal, philosophical and grammatical perspectives are analyzed.
