Through considering the photon propagator in Fermi sea (added to Dirac vacuum), we study the method to expand the photon self-energy coming from the fermion-loop by using the tree diagrams. On the basis of this technique, we consider the structure of chiral anomaly which is related to the one obtained by Nielsen, Ninomiya and Ambjorn et al. As the result, we conclude that the existence of the chiral anomaly will be guaranteed by the stability of the vacuum rather than how the regularization is introduced, provided the gauge invariance holds.
