Not only in Europe and America but also in Japan, the publication of "Lady Chatterley's Lover" caused a great sensation. The trial followed in 1925 in Tokyo was the first to prosecute this notorious novel in the world. We shall examine the case, concerning both law and litterature. Hiroshi Masaki, the barrister, who energetically promoted this whole affair had a firm belief that there could be an invasion of fundamental human rights, while the prosecutors, the court and most eminent scholors and specialists in law recognised it as a problem of criminal law. In course of time, the former interpretation came to be highly evaluated. Our interdiciplinary aproach will find here the difference between law study and literary one and moreover, the succeeding comparative study of the literary trials in various countries will present us their different cultural background.
