Main question in this paper is how the right to education should be institutionally guaranteed in the educational relations in the school, which is organized socially for promoting the development of the social and political faculties of students. I think one answer to this question is the organization of the procedures for students to represent their interests and right to education in the school. This is a reason that I take notice of Student Participation Legislation (Schulervertretung) in West Germany. But, Student Participation Legislation is only a surface layer of realities in the school. So, the realities of student's participation in the school must be investigated. In this paper, I aim to investigate the consciousness of teachers and students concerning the organized participation, and to clarify operational problems of Student Participation Legislation, focusing on the investigation reports that Kultusminister of Nordrhein-Westfalen issued in 1983.
