概要

カリフォルニア渇水銀行（California drought water bank，以下，渇水銀行）は，米国カリフォルニア州で展開されている渇水対応策である。1987年から1992年にかけて同州を襲った記録的な渇水において初めて実験的に導入されて以来，同州の渇水対策として定着した。渇水銀行の特徴は，渇水時における水の配分問題を，利水者同士の自発的な水取引を促すことで解決を試みる点にある。つまり渇水銀行とは市場メカニズムの要素を取り入れた水の再配分政策といえる。<BR>これまでの先行研究によって，制度の概要，長所および問題点などが明らかにされてきたが，直近の2009年の取り組みについては，詳細な研究がなされていない。さらに研究動向全体を通じて渇水銀行における政府の役割，とりわけ水利権の許認可行政の詳細が明らかにされていない。そこで本稿では，2009年の取り組みに注目しつつ，渇水銀行における水利権の許認可行政の仕組みを明らかにし，市場方式の要素を取り入れた水の再配分政策であっても一定の政府活動の余地を残す必要があることを示す。
