• 研究ノート(Note)本稿は、ヘイト・スピーチの規制が憲法的に可能であるかにつき、アメリカの判例、学説を検討するものである。従来、日本では、批判的人種理論がヘイト・スピーチ規制に関するアメリカにおける議論、とくに合衆国最高裁に与えた影響を過小評価してきた感がある。そこで、本稿では、批判的人種理論が合衆国最高裁に与えた影響に注目し、アメリカの議論をみていく。また、批判的人種理論への批判への反論となりうる概念として、「無自覚性」を挙げ、同概念につき検討する。This Note intends to analyze cases and theories relating to hate speech regulations in the United States--especially Critical Race Theory-- . In Japan, the impact that Critical Race Theory has on the decisions of the Supreme Court of the United States has been disregarded. Therefore this Note will focus on the Critical Race Theory in the controversy of hate speech regulations. Then this Note intends to analyze the idea of 'transparency' as an argument against the criticism to the Critical Race Theory.
