The General Assembly of the United Nations adopted and proclaimed the International Year of Disabled Persons (1981) and the World Programme of Action concerning Disabled Persons from the Universal Declaration of Human Rights (1948) via the Declaration on the Rights of Disabled Persons (1975). It was in 1990 when Professor Susumu Sato considered this history of persons with disabilities as "an arrival point" and proposed 5 points concerning their rights: i) we must prescribe the general and comprehensive concept of persons with disabilities, ii) we must extensively guarantee their social security, social welfare, medical care and educational facilities, iii) we must abolish the several discriminations against them, iv) we must understand them, and v) we must clearly state their right to enjoy extensive and concrete services. How did and do we answer to these 5 points proposed by Professor Sato? In this paper, I will discuss this question from the standpoint of the construction of a "new" legal system for persons with disabilities including legal policy.
