As the numbers of foreigners who live in Japan increase, the creation of unregistered children taken care of by the welfare system, such as nursing homes, is also apparently increasing. But these numbers are thought to be only the tip of the iceberg, and the true number is not grasped. The problems of post-war stateless children born in Okinawa, after the revision of the Nationality Law in 1984, were alleviated to some extent. But there are still tasks to be done to smooth out problems in the Nationality Law concerning illegitimate children born between a Japanese father and foreign mother. According to International Covenants on Human Rights B, the Universal Declaration of Human Rights, and the Convention on the Rights of the Child, every person has the right to acquire nationality from the time of birth. Additionally every child must be able to secure a base from which he/she can contribute to the society as a citizen. The purpose of this paper is to consider means to ensure stateless children's rights without being swayed by peculiar characteristics of Japan or their parents' way of living.
