In modern China, it was not until 1999 that the property rights of private enterprises were legally guaranteed by the Constitution. Even before that date, however, private enterprises had grown remarkably in some provinces, especially in rural villages of the Wenzhou area in southern Zhujiang.In an attempt to explain why such enterprises were able to flourish despite strong pressure from the Chinese Communist Party and the government, the author examines the roles played by township and village governments during the period of transition of the economic system. On one hand, the local governing bodies were (and are) the smallest units within the administrative structure; on the other, they have long had certain characteristics of a commune that can supplement market mechanisms supporting the life and livelihood of the people. They provided a degree of certification for private enterprise owners wishing to do business well beyond provincial boundaries; they also permitted owners to deal with residents of remote areas under the name of a collective enterprises, in order to avoid potential problems. By such means, shareholding co-operatives, nominally regarded as collectively owned companies, could also surmount difficulties stemming from the instability of property rights, and thus make further contributions to regional economic development.
