In the common law world, the question of choice of the applicable law to determine whether relief should be granted has merited little discussion. This is because divorce was regarded as a question of status. Therefore, only the courts of the domicile could have jurisdiction to grant divorces and they applied their own law as the lex fori. In the common law jurisdiction, it is a self-evident truism that the lex fori must be regarded as the law applicable to divorce. In the late 1950s and early 1960s there took place a dramatic revolution in American conflict of laws. Many states abandoned the traditional choice of law approach and adopted a new approach. This new choice of law approach, which is called governmental interests analysis doctrine, focuses on the actual law that competes for application and assesses states' interests in the law selected to control the legal issue in dispute. Has the arrival of interests analysis on the conflicts field led to any change in the American approach to choice of law in divorce? The purposes of this article are to examine the following matters : (1) the difference of approach to divorce choice of law between common law and civil law systems ;(2) the lex fori as the law applicable to divorce ;(3) governmental interests analysis doctrine ;(4) the impact of interests analysis on the American divorce conflicts ;(5) the policies underlying substantive law of divorce and divorce choice of law rules.
